Welcome to Havila Cakes (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern all orders, purchases, and services provided by us, including custom cakes and other baked goods. By placing an order, you agree to be bound by these Terms.

Important: We have a no-refund policy, payment is required to confirm all orders, and we do not ship cakes out of state.

Pickup, Delivery & Shipping

 Pickup

  • You are responsible for ensuring safe transportation of cakes and baked goods after pickup.
     
  • Once the order leaves our premises, we are not liable for any damage due to handling, transport, storage, or environmental conditions.
     

 Local Delivery

  • Delivery may be available within Aurora/Denver/Metro for an additional fee.
     
  • Delivery time windows are approximate; we will make reasonable efforts to deliver within the agreed timeframe.
     
  • If no one is available to receive the order, we may:
     
    • Leave the order at the specified location (at your risk), or
       
    • Return the order, and you may be charged an additional fee for re-delivery or pickup.
       

No Out-of-State Shipping

  • We do not ship cakes out of state.
     
  • All cake orders are limited to Colorado only.
     
  • We are not responsible for any third-party shipping arranged by you.


Product Quality, Design & Allergies

 Design & Decoration

  • We will make every reasonable effort to match colors, designs, and themes as requested, but slight variations may occur due to artistic interpretation, materials, and lighting.
     
  • By placing an order, you acknowledge that some variation is normal in handcrafted products.
     

 Taste & Texture

  • Cake and frosting flavors, moisture, and texture may vary slightly due to ingredients, climate, and storage conditions.
     
  • No refunds will be issued based on personal taste preferences.
     

 Allergens & Dietary Restrictions

  • Our products may contain or come into contact with common allergens such as eggs, dairy, wheat (gluten), nuts, soy, and others.
     
  • It is your responsibility to inform us of any allergies or dietary restrictions when placing an order.
     
  • While we take precautions, we do not guarantee an allergen-free environment and are not liable for any allergic reactions.
     

Return and Refund Policy

Orders & Payment

Order Confirmation

  • All orders (including custom cake orders) must be confirmed with full payment or a non-refundable deposit as specified by us at the time of ordering.
     
  • An order is not confirmed until payment has been received and we have issued written confirmation (email, text, or invoice).
     

Payment Methods
We accept the following payment methods:

 No Refund Policy

  • All payments are final and non-refundable.
     
  • This includes deposits, partial payments, and full payments for all products and services.
     
  • If you cancel or fail to pick up your order, you will not receive a refund or store credit, except where required by law.

Changes, Cancellations & No Refunds

Order Changes

  • Minor changes (e.g., color tweaks or wording) may be possible up to [2 days] before your event date, subject to our approval and schedule.
     
  • Significant design changes may result in additional charges or may not be possible if too close to the event date.
     

Cancellations

  • You may cancel your order; however, all payments are non-refundable.
     
  • In limited cases and at our sole discretion, we may offer to reschedule your order or apply part of your payment as a credit toward a future order, but we are not obligated to do so.
     

No-Show / Late Pickup

  • If you fail to pick up your order on the agreed date and time, we are not responsible for product condition or replacement.
     
  • No refunds or credits will be provided.
